Terms and Conditions of Business

Delivery Arrangements: Delivery of the Goods shall be made by Casstrom Limited via our UK warehouse delivering the Goods to the place in the United Kingdom specified on the Buyer's order. All deliveries are sent using tracked UPS or Royal Mail’s recorded services to ensure that all goods reach you securely. The Delivery Date is approximate only and the buyer will be notified of any excessive delays. If the Buyer fails to take delivery of the Goods, any costs incurred by Casstrom Limited will be reclaimed.

Damage or Shortage Claims: Damaged deliveries must be immediately reported to the delivery firm at time of delivery and signed for as “damaged”. Goods should be inspected immediately upon receipt and any damages or shortages need to be immediately reported to Casstrom Limited. Any hidden damages or shortages must be reported within 5 days of receipt of delivery.

Back Orders: All back orders will be considered open unless cancelled by the customer, please inform Casstrom Limited as soon as possible of any changes to the back order details.

Payment Terms: Subject to any special terms agreed in writing between the Buyer and Casstrom Limited who shall invoice the Buyer for the price of the Goods after processing the order. The Buyer shall pay the price of the Goods (less any discount or credit allowed by Casstrom Limited, but without any other deduction credit or set off) on or before the specified due date stated on the invoice. Receipts for payment will be issued only upon request.
Payment should be made via BACS unless a special agreement has been made with Casstrom Ltd.

Late Payments: If your payment has not been received in accordance with the stated terms Casstrom Limited will exercise their statutory right to claim interest (at 8% over the Bank of England base rate) and compensation for debt recovery costs under the Late Payment legislation. Failure to act on reminders will result in the matter being handed over to a debt collection agency, solicitors or the courts of law. As well as charging interest Casstrom Limited may also claim a fixed cost for the recovery of late payments.

Credit Limits: Credit limits are evaluated on a case by case basis and Casstrom Limited reserves the right to change the credit limit at any time.

Retention of Title: Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery or, if the Buyer wrongfully fails to take delivery of the Goods, the time when Casstrom Limited has tendered delivery of the Goods. Notwithstanding delivery and the passing of risk in the Goods, or any other provision of these Conditions, legal and beneficial title of the Goods shall not pass to the Buyer until Casstrom Limited has received in cash or cleared funds payment in full of the price of the Goods. Notwithstanding, legal and beneficial title of the Goods shall not pass to the Buyer until Casstrom Limited has received in cash or cleared funds payment in full of the price of the Goods and any other goods supplied by Casstrom Limited and the Buyer has repaid all moneys owed to the Seller, regardless of how such indebtedness arose.

Until payment has been made to Casstrom Limited in accordance with these Conditions and title in the Goods has passed to the Buyer, the Buyer shall be in possession of the Goods as bailee for Casstrom Limited and the Buyer shall store the Goods separately and in an appropriate environment, shall ensure that they are identifiable as being supplied by Casstrom Limited and shall insure the Goods against all reasonable risks. The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the goods which remain the property of Casstrom Limited, but if the Buyer does so all money owing by the Buyer to Casstrom Limited shall (without prejudice to any other right or remedy of Casstrom Limited) forthwith become due and payable.
Casstrom Limited reserves the right to repossess any Goods in which Casstrom Limited retains title without notice. The Buyer irrevocably authorises Casstrom Limited to enter the Buyer’s premises during normal business hours for the purpose of repossessing the Goods in which Casstrom Limited retains title. The Buyer’s right to possession of the Goods in which Casstrom Limited maintains legal and beneficial title shall terminate if;

a) The Buyer commits or permits any material breach of his obligations under these Conditions;

b) The Buyer enters into a voluntary arrangement under Part 1 of the Insolvency Act 1986, or any arrangement is made with his creditors;

c) The Buyer is or becomes the subject of a bankruptcy order or takes advantage of any other statutory provision for the relief of insolvent debtors;
d) The Buyer convenes any meeting of its creditors, enters into voluntary or compulsory liquidation, has a receiver, manager, administrator or administrative receiver appointed in respect of its assets or undertaking or any part thereof, any documents are filed with the court for the appointment of an administrator in respect of the Buyer, notice of intention to appoint an administrator is given by the Buyer or any of its directors or by a qualifying floating charge-holder (as defined in paragraph 14 of Schedule B1 of the Insolvency Act 1986), a resolution is passed or petition presented to any court for the winding up of the Buyer or for the granting of an administration order in respect of the Buyer, or any proceedings are commenced relating to the insolvency or possible insolvency of the Buyer.

Returns: If there are defective goods found within the delivery then Casstrom Limited will need to be contacted immediately and the faulty item/s returned. If you wish to return goods for other reasons you must seek agreement from Casstrom Limited who may at its discretion agree to this and if so ask that the below outlined procedures are followed. All goods sent back, for any reason, must be agreed with a Casstrom Limited representative first and must be sent using a recorded or traceable delivery service as per agreement. No refund or replacement will be given if the goods do not reach Casstrom Limited. Returns must include a list detailing your contact details and the returned products and quantities. Normally all returns should be sent to our agent:

Once the items have been received a replacement or refund will be arranged as per agreement.

Complaints:
All complaints should be sent in writing to Casstrom Limited, PO Box 4160, Maidenhead, SL60 1DR. Complaints will be dealt with promptly.

Pricing: A trade price list is published but all pricing can be subject to change without prior notice. Casstrom Limited reserves the right to make product changes without incurring any obligation to replace modify or change products previously sold. All prices are subject to VAT at the current rate.
